On May 29, 1992, Barry Riddle filed a civil action against the National Railroad Passenger Corporation in the United States District Court for the Eastern District of Pennsylvania (“Riddle I ”). He alleged that defendant failed to use ordinary care to famish plaintiff with a safe work environment; subjected him to unsafe and inadequate working conditions and a hostile work environment; and conducted an intentional campaign of investigations and harassment.
