In these two separate cases, we are asked to determine whether the city of Detroit Police Department can be held liable for the death of John Rogers and the personal injuries of Deborah and Krystal Ewing. In both cases, police officers attempted to stop a motorist; the motorist fled and subsequently caused an automobile accident, killing or injuring a third-party motorist. In neither case was the police vehicle physically related to the accident other than by the fact that it was pursuing the vehicle that struck the plaintiffs car.
