JOURNAL ENTRY AND OPINION

{¶ 1} This cause came on to be heard upon the accelerated calendar pursuant to App.R. 11.1 and Loc.R. 25, the records from the Cuyahoga County Court of Common Pleas and the briefs of the parties.

{¶ 2} In April 1987, appellant was convicted of murder with a firearm specification and having a weapon while under disability. His conviction and sentence was upheld on direct appeal to this court.
