*1138Appeal from an order of the Court of Claims (Renee Forgensi Minarik, J.), entered May 2, 2008. The order denied claimant’s motion for partial summary judgment and granted the cross motion of defendants for summary judgment dismissing the claim.
It is hereby ordered that the order so appealed from is unanimously reversed on the law without costs, the cross motion is denied, the claim is reinstated and the motion is granted.
