Appeal by the defendant from a judgment of the Supreme Court, Kings County (Broomer, J.), rendered June 12, 1990, convicting him of robbery in the first degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is affirmed.

Contrary to the defendant’s contentions, the trial court did not commit reversible error by denying his request for a missing witness charge. The People cannot raise the issue of the untimeliness of the defendant’s request for the first time on appeal (People v Erts, 73 NY2d 872, 874; People v Brown, 183 AD2d 569).
