WESTERFIELD, Judge.

This is an appeal from a judgment maintaining an exception of no cause of action.

Plaintiff’s petition in effect alleges that she is entitled to the avails of an industrial life insurance policy issued on October 31, 1898, by the defendant Life Insurance Company of Virginia, to her late father, Chris Harris, who died in 1933, after having paid the’premiums due under the policy up to March 12, 1923; that at the time, of the default of the payment of premiums May 19, 1923, the policy had a paid-up value of $95.70; that the insurer resists payment, upon the ground that no…
