Appellants are tbe executors, appointed in the state of New York, of the estate of Archibald C. Smith, a citizen and resident of that state, who died testate therein on October 10, 1923. At the time of his death, he was the owner of, and had in his possession in New York, certain notes executed to him by the residents of Iowa, and secured by mortgages upon real estate in Iowa. The treasurer of this state demanded, and was paid by appellants, a succession tax, amounting-to $35,337.72.
