Defendant was charged with Count I, assault with intent to murder, MCL 750.83; MSA 28.278, Count II, first-degree criminal sexual conduct, MCL 750.520b; MSA 28.788(2), and Count III, breaking and entering with intent to commit criminal sexual conduct, MCL 750.110; MSA 28.305. On August 3, 1979, he was convicted by a jury of Count I, felonious assault, MCL 750.82; MSA 28.277, and Count II, first-degree criminal sexual conduct. He was acquitted of the charge in Count III. Defendant was sentenced to concurrent terms of 2 years and 8 months to 4 years imprisonment on the felonious assault…
