This case presents the issue of whether the Third Circuit Court properly granted Defendant-Appellee State of Hawaii’s (the State) motion for summary judgment on the issue of whether the statute of limitations provided for in Hawai'i Revised Statutes (HRS) § 662-4 (1993)1 had applied and run when *242Plaintiff-Appellant Florence Anderson (Anderson) presented some evidence that the State may have committed a continuing tort against her property.
