Plaintiff, Town of Evans, has moved for summary judgment against defendant Catalino and his surety, Aetna Insurance Company, seeking an accounting, surcharge of Catalino in order to restore funds in the amount of $167,000 plus interest which plaintiff alleges were illegally transferred, and the imposition of a civil penalty against Catalino. By cross motion defendant Catalino seeks summary judgment dismissing the complaint for failure to state a cause of action.
