NATURE OF CASE

Relator, the Counsel for Discipline of the Nebraska State Bar Association, now known as the Counsel for Discipline of the Nebraska Supreme Court, initiated this attorney discipline proceeding against respondent Kelly M. Hogan. Formal charges were filed against respondent alleging ethical violations. A referee was appointed who heard evidence, made findings of fact, and recommended discipline. No exceptions were filed to the referee’s report. We sustained relator’s motion for judgment on the pleadings in part and adopted the referee’s findings. We reserved the issue of the…
