I. Denial of Motions for Directed Verdict and Judgment Notwithstanding the Verdict

Defendant W. T. Combs, Jr., assigns error to the denial of his motion for directed verdict at the close of plaintiffs’ evidence and of his motion for judgment notwithstanding the verdict. The motions present the question whether the evidence, in the light most favorable to plaintiffs, constituted “ ‘any evidence more than a scintilla’ to support plaintiffs’] prima facie case in all its constituent elements.” Hunt v.
