Pearson, Vice-Chancellor:

The corporation surviving a merger filed a petition for a determination of the persons entitled to an appraisal and payment of shares of its preferred stock, and for the appointment of an appraiser, pursuant to Section 61 of the Corporation Law. A considerable number of stockholders had filed purported objections and demands.
