INTRODUCTION
This patent matter was initiated on January 29, 2007 in which Venetec International, Inc. (“Venetec”) alleges that Nexus Medical, LCC’s (“Nexus”) product, “The Bone,” infringes U.S. Patent Nos. 6,213,-979 (the “'979 patent”) and 6,447,485 (the “485 patent”). 1 Venetec moved for partial judgment on the pleadings pursuant to Federal Rule of Civil Procedure (“Fed.
