The defendant, Hezekiah W. Barnes, having been charged with the crime of murder in the first degree and convicted, judgment and sentence were entered, and he has appealed.
*494By his first assignment of error appellant contends that his plea of former acquittal should have been sustained, and that he should have been discharged by the trial court.
