Appellant and appellee Avere married in 1915. Appellee was a man well along in years, Avhile the appellant was middle-aged. He was quite Avealthy and she was in very moderate circumstances. Before the marriage took place they entered into an agreement, Avherein they settled their property rights when married. This agreement reads as follows:

“This agreement made this 9th day of April, A. D. 1915, by and between Christopher Tiernan of Lincoln, Nebraska, party of the first part, and Elizabeth Schulte of Lincoln, Nebraska, party of the second part, witnesseth:
