Plaintiff, on September 8, .1920, entered into' a written contract wiih Charles E. Rieldey, as the owner of the property, for the purchase of certain real estate in Omaha. *447Part of the price Avas paid in cash, and the balance was to be paid in monthly payments. None of these deferred payments has been made because one Thomas W. Armstrong claims an interest in the real estate as the heir of his mother, Mary A. Rickley, formerly Mary A. Armstrong.
