Appellees brought this action in the circuit court of Hinds county against appellant to recover the face value of a life insurance policy of five thousand dollars, issued by appellant on the life of Byron B. Boling, de ceased. The trial resulted in a judgment in appellees’ favor for the amount sued for. Prom that judgment appellant prosecutes this appeal.

At the time of the death of the insured, the policy had been in force more than three and less than nine years. The insured had defaulted in the payment of premiums and had secured a loan on the policy. The policy contained, among others,…
