Plaintiff-appellant State of Hawai'i [hereinafter, the prosecution] appeals from the Circuit Court of the Third Circuit’s September 30, 2005 order granting defendant-appellee Alvin Kalaokoa Perez’s motion to suppress evidence of drugs and drug paraphernalia found in his coin purse after he was arrested for shoplifting, given a pat-down search, detained for two hours, and then had his coin purse searched pursuant to a search warrant issued based on a canine screening of his coin purse at the end of the two-hour detention. 1 On appeal, the prosecution contends…
