Background

On December 1, 2006, Plaintiff Barr Incorporated, a Connecticut corporation based in Connecticut, filed a Complaint in this court alleging that Plaintiff was the lowest bidder for a contract to build a new Falmouth Public Library. Defendant Town of Falmouth (“Falmouth”), a Massachusetts town, rejected Plaintiffs bid, after determining Plaintiff was not a responsible bidder. Defendant Falmouth instead awarded the construction contract to Defendant J.K. Scanlan Co., Inc. (“Scanlan”), a Massachusetts company based in Massachusetts. Plaintiff alleges that…
