THOMAS, District Judge.

On October 14, 1920, a creditors’ petition for the appointment of a receiver was filed in this court. The petition set forth that “it satisfactorily appears that it is absolutely necessary for the preservation of the estate of Holmes Manufacturing Company that a receiver he appointed to take charge of and to hold such estate and that he continue the business of said Holmes Manufacturing Company.” On the same day Peter Lenz was appointed receiver.
