The defendants’ motion pursuant to CPLR 3211 for an order *485granting them judgment and dismissing the action is granted, and the complaint is dismissed.

The instant action arises from a collision between a bus owned and operated by the defendants which struck and injured Irving Cashin on November 4, 1996. Defendant Sever-son was the bus operator at the time of the accident.
