The defendant was found guilty by a jury on three indictments. One (No. 7084) charged breaking and entering in the night time the China Clipper Restaurant of Don H. Leung in New Bedford with intent to commit larceny. G. L. (Ter. Ed.) c. 266, § 16, as appearing in St. 1943, c. 343, § 1. The second (No. 7085) charged possession of burglarious implements with intent to use as such. G. L. (Ter. Ed.) c. 266, § 49. The third (No. 7086) alleged an attempt to break the safe of Don H.
