MEMORANDUM OPINION AND ORDER

MUKASEY, District Judge.

On October 26, 1982, Michael Proulx, an employee of Citibank, N.A., filed a complaint with the New York State Division of Human Rights (“DHR”) charging Citibank, through the acts of Proulx’s supervisor, Robert Ganey, with sexual harassment in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq. After that agency failed to sustain his claim and the Equal Employment Opportunity Commission adopted that conclusion as its own, he sued in this Court.
