This case is before the court on defendant’s Motion for Summary Judgment. (Doc. 16.)1 Plaintiff claims that defendant, her former employer, discriminated against her based on her race and retaliated against her for asserting rights under the Family Medical Leave Act (“FMLA”). Upon consideration of the Motion, the supporting and opposing memoranda, argu*1316ments of counsel and the relevant law, the court finds, for the reasons stated below, that defendant’s Motion is due to be granted.
