OPINION

PARKS, Judge:

Appellant, Adolph Honel Munson, was tried by jury in Custer County District Court, Case No. CRF-84-129, and convicted of First Degree Murder (21 O.S. 1981, § 701.7) (Count I), Kidnapping (21 O.S. 1981, § 741) (Count II), and Robbery With Firearms (21 O.S. 1981, § 801) (Count III), before the Honorable Gary McGinn, District Judge. The jury found the murder was committed to avoid a lawful arrest or prosecution, that appellant constituted a continuing threat to society, 21 O.S. 1981, § 701.12(5) & (7), and sentenced appellant to death on Count I, ten (10) years on Count II,…
