OPINION AND ORDER

JAMES E. DOYLE, District Judge.

Defendant has been indicted and tried for willfully and knowingly refusing to submit to induction into the armed services of the United States in violation of 50 U.S.C.App. § 462. The case was tried to this court without a jury on July 27, 28, and 29, 1970. At the conclusion of the government’s case and again at the conclusion of all the evidence, defendant moved for a judgment of acquittal and the court reserved a ruling on the motion.
