— Appeal by defendant from a judgment of the Supreme Court, Kings County, rendered June 9, 1975, convicting him of attempted murder of a peace officer, robbery in the first degree and possession of a deadly weapon, upon a jury verdict, and imposing sentence. Judgment reversed, on the law, and new trial ordered. Defendant stands convicted of the crime of attempted murder of a peace officer, committed during the course of an aborted robbery at a Transit Authority token booth on May 13, 1974.
