WOODBURY, Circuit Judge.
This is an appeal from a final judgment in a suit for patent infringement wherein the court below dismissed the plaintiff’s complaint and also its counterclaim for an accounting and royalties, and awarded the defendant $6,999.49, with interest at 6 per cent from June 29, 1950, and costs, on its counterclaim for certain royalties which it alleged it paid the plaintiff “under protest and without prejudice” under circumstances to be presently described.
