Ludlum v. Couch

Appeal by the defendant, Louis B. Couch, from a judgment of the County Court of Bockland county in favor of the plaintiff, entered in the office of the clerk of the county of Bockland on the 9th day of March, 1896, upon the decision of the court reversing a judgment rendered by a justice of the peace on an appeal therefrom which was heard upon a return containing the evidence taken before the justice.

Bradley, J.:
The plaintiff, who may be deemed to have been a professional nurse, was requested by the defendant to go to the residence of Peter Post, some of the members of whose family were side with diphtheria, and nurse them. The defendant was a physician and a health officer of the village of Hyack. The evidence on the part of the plaintiff is to the effect that, when the defendant directed the communication of his request to her, he stated that he would see her paid for the service and that such statement was by the messenger communicated to her with the request.
