Before the Court is defendants Geneviere Switz (s/h/a Geneve Switz) (“Switz”), Pedro Diaz (“Diaz”), and New York State Department of Correctional Services’ (“DOCS”) motion to dismiss [8] pro se plaintiff Allah Kasiem’s (“Kasiem”) complaint pursuant to Federal Rules of Civil Procedure 12(b)(1) and 12(b)(6).
