1Opinion of the CourtFead, J.
In August, 1929, William P. Glavin was killed while in the employ of defendant Michigan State highway department. An agreement for compensation of $18 per week was entered into, naming as his dependents Margaret, his widow, William, his 15-year old son, and Marguaretta, his 17-year -old daughter. The official approval of the agreement was evidenced by a letter from the department of labor and industry, by its secretary, to the defendant State accident fund:
“The agreement in regard to compensation in the above case has been passed upon by the department of labor and industry and approved.”
