This is an action in ejectment and for the partition • of real property and for rents and profits. It was tried to the court. *344Judgment was rendered for the plaintiff, and the defendant has appealed.

All parties claim through Andrew D. Shaw, who in 1872 and for several years prior thereto owned and with his family resided upon all that part of the west half of section 20, township 9, range 10 east, lying north of Rock Creek, in Pottawatomie county, Kansas, and containing approximately 170 acres.
