This habeas corpus proceeding was commenced on behalf of Clay D. Rhodes, a person detained by the Sheriff of the County of Rensselaer. The petitioner is the defendant’s attorney.

The facts are as follows: defendant Rhodes was arrested on July 7, 1989 and charged with the crime of burglary in the second degree, a class C felony. The defendant was arraigned in Troy Police Court and was initially remanded to the Rensselaer County Jail without bail. A preliminary hearing was scheduled but was not held.
