The record in this case shows that on February 28, 1929, one Benbough, referred to in respondent’s answer as now operating under the name “H. L. Benbough Ltd.”, and in the findings as “Benbough Furniture Company”, sold to one Todd, under a conditional contract of sale, certain listed furniture and furnishings placed in the premises known as the Todd Apartments at San Diego, California, for $10,331.88.
