[¶ 1] The mother and father of Cody T. appeal from the judgment of the District Court (Bangor, Gunther, J.) terminating their parental rights pursuant to 22 M.R.S. § 4055(1)(B)(2) (2008). The mother and father assert that the evidence is insufficient to support, by clear and convincing evidence, the finding of parental unfitness. Additionally, the father asserts that service by publication in Maine and other unsuccessful efforts to notify him in advance of the jeopardy hearing violated his rights to due process. We affirm the judgment as to the mother. We vacate the judgment as to the father.…
