Appeal by the defendant, Hamline Q. French, from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the •30th day of December, 1902, appointing a referee in the action to hear and determine.

Ingraham, J.:

The action is upon an account stated, the complaint alleging that the plaintiffs were stockbrokers in the city of New York; that on ■or about the 14th day of May, 1901, an account was stated between the plaintiffs and the defendant, a copy whereof is annexed to the *453complaint; that upon such statement a balance of $15,500.33 was found due to the plaintiffs from the defendant. The account attached to the complaint shows a dealing in various stocks aggregating an amount of over $236,000, with a balance in favor of the plaintiffs for which the action is brought.
