The defendant Iiuiskamp filed with his argument an “amended abstract,” consisting of the written opinion of the learned judge who ruled upon the demurrer, and this the plaintiffs move to strike from the files, “because the same is no part of the -record appealed from.” We 1 have held that it is not improper to include in the abstract or the additional abstract the written opin- ■ ion of the lower court in the case, and that it will not be stricken on motion.
