Appeal by the plaintiff, the Union Associated Press, from a judgment of the Supreme Court in favor of the defendant, entered in the office, of the clerk of the county of New York on the 27th day of March, 1899, upon the' dismissal of the complaint by direction of the court after a trial before the court and a jury at the New York Trial Term.

The action was brought to recover damages for a libel which the defendant had published, the complaint alleging that the plaintiff, *248whose business was to collect news and furnish it to daily and other newspapers, had obtained such news from another corporation, (known as the Associated Press, engaged in the same business) by tapping the wires used by the Associated Press. The complaint, further alleges that, by reason of the publication of the said article-by the defendant, the reputation of the plaintiff was greatly damaged,, and the confidence which thé public generally had…
