Plaintiff in error, George W. Jackson, was indicted in the district court of Atoka county, on the 17th day of September, 1909, whereby he was charged with having on the 22d day of February, 1909, committed the crime of stealing six head of cattle, the property of Dave Crawford. Upon his trial, the jury returned a verdict of guilty as charged and assessed his punishment at imprisonment in the state penitentiary for six years. This appeal is prosecuted from the judgment and sentence rendered in accordance with the verdict of the jury on the 3d day of December, 1911.
