At the outset, we are asked to pass upon the effect of the judgment of this court when this case was previously here, and when it was reversed and remanded. (142 Ill. App. 126.) We cannot go to the length urged by the appellee and hold that such decision constitutes res judicata as to the entire case. That decision is now binding upon us to the extent of holding that the case was one which should properly be submitted to tbe jury, and one upon which a verdict might be found against the defendant; therefore, we do not regard these…
