This is an appeal from a judgment of the Appellate Court for the Fourth District affirming a judgment of the circuit court of St. Clair county in favor of the appellee and against the appellant, for negligently causing the death of James Askew, appellee’s intestate.

The declaration contains one count, which alleges, in substance, that the defendant was the owner of a plant for the manufacture of brick; that it kept upon its yards a pile of clay one hundred and fifty feet long, fifty feet wide and fifteen feet high, the breast of which was perpendicular; that from the manner in which the clay…
