We granted further appellate review to determine if the defendant’s conviction of assault with intent to murder while armed with a dangerous weapon, G. L. c. 265, § 18, is precluded by principles of collateral estoppel. See Ashe v. Swenson, 397 U.S. 436 (1970). The Appeals Court affirmed the conviction, Commonwealth v. Lopez, 10 Mass. App. Ct. 351 (1980), and the defendant sought further appellate review. We affirm.
