SMITH, Circuit Judge.
Trey Michael Boykin was convicted of one count of kidnapping, in violation of 18 U.S.C. § 1201, and one count of-conspiracy to distribute marijuana, in violation of 21 U.S.C. §§ 841(a)(1), 841(b)(1)(D), and 846. On appeal, Boykin argues that the superseding indictment was missing an essential element on the kidnapping charge, rendering the indictment fatally flawed and entitling him to a judgment of acquittal.
