This is an action brought by the State on the request of the railroad commission to recover penalties for the failure of the defendant to comply with an order of the commission to extend its water mains in the city of Wash-burn. It is alleged in the complaint as a first cause of action that the defendant is a corporation, a public utility engaged in the operation of its plant, and that on the 7th of December, 1917, the railroad commission of Wisconsin, acting within its jurisdiction in a proceeding brought by John Horan and twenty-five other persons, entered an order *288that defendant extend its…
