In this suit the purchasers of a piece of property at 3240 Getty street in Muskegon seek a declaratory judgment to determine to whom to make the balance of their mortgage payments. The question posed is whether or not the mortgage was owned jointly by a husband and wife with the right of survivorship, or whether an agreement made between the husband and wife prior to the husband’s death had changed the ownership to a tenancy in common.
