ARCHBAKD, District Judge.
This is an action to enforce against the defendants, as directors of the Western Montana Placer Mining Company, the liability imposed by the Montana statutes for failure to file an annual statement of the financial affairs of the company.
The facts are as follows: The company is a Montana corporation, and the defendants were chosen directors at the annual meeting held January 8, 1901, and served as such for that year, filing a financial statement in due form at the required time in September following.
