The appellant and plaintiff below, James Bucky LeMaster, acting as the Personal Representative of the Estate of Janet Leigh Hough, appeals from the September 9, 1997 order of the Circuit Court of Berkeley County which dismissed his wrongful death action against appellee and defendant below, John B. Myrick. On appeal, the appellant contends that the circuit court erred in granting the appellee’s motion to dismiss. For the reasons that follow, we find the circuit court’s ruling to be erroneous. Accordingly, we reverse and remand this case for further proceedings consistent with this opinion.
