Before the Court for determination is the “Motion of Landlord for Order Directing Chapter 7 Trustee to Make Immediate Payment of Administrative Rent Claim” (the “Payment Motion”) filed by Woburn Mall Associates (the “Landlord”). The issue for determination is whether section 365(d)(3) of the Bankruptcy Code requires that a commercial lessor’s Chapter 11 administrative claim for postpetition, pre-rejection rent be paid immediately with priority over other unpaid Chapter 11 administrative claims and unpaid Chapter 7 administrative claims…
