Juan Antonio Lamar Kinley appeals from a judgment of the Clark County Court of Common Pleas, which dismissed his petition for postconviction relief without a hearing.

In 1989, Kinley was accused of the murders of his girlfriend, Thelma Miller, and her twelve year old son, David. The Millers were hacked to death with a machete on January 10, 1989, in the garage of Richard and Elaine Szulewski, for whom Thelma had worked as a housekeeper.
